Understanding UAE’s Decree 9/24
The United Arab Emirates (UAE) has enacted significant amendments to its labour law through Federal Decree-Law No. 9 of 2024, effective from 31 August 2024. These changes aim to enhance worker protections, ensure fairer employment practices, and align the UAE’s labour regulations with international standards.
Key Amendments to the UAE Labour Law
- Extended Statute of Limitations for Labour Claims—The period for filing labour disputes has been extended from one year to two years from the date of employment termination. This extension applies to both employees and employers, providing a longer timeframe to address and resolve employment-related grievances.
- Enhanced Penalties for Labour Law Violations—Penalties for employers violating labour laws have been significantly increased. Previously, fines ranged from AED 50,000 to AED 200,000. Under the new amendments, fines can reach up to AED 1 million, depending on the severity and nature of the violation.
- Strengthened Worker Protections—The amendments bolster protections against arbitrary dismissal, ensuring that terminations are justified and documented. Additionally, the law now mandates clearer guidelines for employment contracts, promoting transparency and fairness in employer-employee relationships.
- Introduction of Flexible Work Arrangements—Recognizing the evolving nature of work, the law introduces provisions for flexible work models, including part-time, temporary, and remote work arrangements. This aims to cater to diverse workforce needs and promote work-life balance.
- Revised Non-Compete Clauses-The enforceability of non-compete clauses has been refined. Such clauses must now be reasonable in terms of duration, geographical scope, and the nature of work to be considered valid, preventing undue restrictions on employees’ future employment opportunities.
- Enhanced Maternity and Paternity Benefits-The amendments provide improved maternity and paternity leave benefits, reflecting the UAE’s commitment to supporting working families and promoting gender equality in the workplace.
- Anti-Discrimination Measures-The law introduces stricter anti-discrimination provisions, prohibiting discrimination based on race, color, sex, religion, national origin, or social origin. This move aims to foster a more inclusive and equitable work environment.
